Terms of Service

1. Acceptance of Terms

By accessing or using ShinyBinder.com ("ShinyBinder," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use ShinyBinder. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. Description of Service

ShinyBinder is a trading card game (TCG) inventory management platform that allows users to track their card collections, record pack openings, build decks, and manage inventory. The Service is available on a freemium basis, with optional paid subscription tiers ("Supporter Tier") that unlock additional features.

4. Accounts

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

5. Subscriptions and Payments

ShinyBinder offers a free tier and a paid Supporter Tier. Subscriptions to the Supporter Tier are billed on a recurring basis. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Auto-Renewal. Subscriptions auto-renew at the end of each billing period. We will send a reminder email before each renewal so you have the opportunity to cancel if you no longer wish to continue.

Plan Changes. You may upgrade from a monthly plan to an annual plan at any time; any unused portion of your current billing period will be applied as a prorated credit toward the new plan. To downgrade from an annual plan to a monthly plan, cancel your current subscription and resubscribe on a monthly basis after your current period expires.

Failed Payments. If a payment fails, your subscription will be temporarily suspended. If payment is not resolved within 7 days of the failed charge, the subscription will be canceled and you will lose access to Supporter Tier features.

Price Changes. We reserve the right to change subscription pricing. We will provide at least 30 days' advance notice of any price change by email to the address associated with your account. If you do not cancel before your next renewal date, you agree to the new pricing.

Cancellation. You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods unless required by applicable law.

Payment Disputes. If you file a payment dispute (chargeback) with your bank or card issuer and the dispute is resolved in your favor, ShinyBinder reserves the right to cancel your subscription without further refund and, where appropriate, suspend your account.

6. User Content

You may upload content to ShinyBinder, including but not limited to card images, profile pictures, and video recordings of pack openings ("User Content"). You retain ownership of your User Content.

By uploading User Content, you grant ShinyBinder a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for your User Content and represent that you have all rights necessary to upload it. You agree not to upload content that is illegal, infringing, or harmful.

By accepting these Terms, you agree that your pack opening data (card, set, and finish information only) may be used to compute aggregated community pull rate statistics. Only combined totals across all workspaces are displayed publicly — your workspace is never individually identified. You may opt out at any time via Settings → Privacy.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to the Service or its related systems
• Interfere with or disrupt the integrity or performance of the Service
• Use automated systems (bots, scrapers, etc.) to access the Service without our express permission
• Impersonate any person or entity
• Upload or transmit viruses, malware, or other harmful code

8. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by ShinyBinder and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works of the Service without our prior written consent.

Trading card names, images, and related intellectual property belong to their respective owners (e.g., The Pokémon Company, Wizards of the Coast, Konami, etc.). ShinyBinder is not affiliated with or endorsed by any TCG publisher.

9. Third-Party Services

ShinyBinder may integrate with third-party services (e.g., eBay, Google Authentication). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the availability or practices of third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHINYBINDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless ShinyBinder and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Texas.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

17. Business Transfers

If ShinyBinder is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or substantially all of its assets, your account and associated data may be transferred to the successor entity. We will notify you by email or prominent notice on the Service if such a transfer occurs. If you do not wish to continue under the new entity, you may cancel your account and subscription at that time.
